Hearing # 1
On Monday, February 2, 2009, at 7:15 p.m., Chairperson T=
om
Braun called a Public Hearing to order. Other members present were Eric Min=
ks, Carl
Sanford, Larry Ziebarth, Eugene Stoeckel, Mark Riverblood and Town Board
liason, John Moosbrugger. The
purpose of the Public Hearing was to consider adding a 60 day expiration for
the recording of landsplits.
Tom Braun stated that there was a letter from Todd McLou=
th
which said that they may want to look at numbers 4 and 5 of that section
because they were both somewhat confusing. John Moosbrugger stated that
ordinance has always been hard to read, but that’s just the way it is=
. He
doesn’t think that needed to be messed with right now.
There were no residents who wished to speak.
Tom Braun motioned to close the Public Hearing at 7:27 p=
.m.
Regular
Meeting
At 7:30 p.m. Planning Commission Chairperson Tom Braun c=
alled
the Regular Monthly Planning Commission Meeting to order.
A motion was made by Larry Ziebarth and seconded by Carl
Sanford to approve the minutes of January 5, 2009 as printed. Motion Carried.
The next item up for business was to discuss adding a No
Parking Policy in the ordinances. Tom Braun asked if the parking issue would
just be for the winter months. John Moosbrugger explained that it is a
snowplowing and cul-de-sac issue. If someone is parked in the cul-de-sac, t=
he
snowplow operator can’t get around them.
Larry Ziebarth found that statement #4 in the section
700:240 of the ordinances pertained to the parking issue. Tom Braun then
indicated that #18 in that same section states that “Any unattended
vehicle, which constitutes an obstruction to traffic or hinders snow remova=
l or
street improvement” is declared a public nuisance. John Moosbrugger
stated since the ordinance does actually cover the parking issue, they have=
to
decide if the snowplow operator should slap a notice on windshields if some=
one
is in the way or if they want to put a sign up in each cul-de-sac stating t=
he
Township Ordinances prohibits blocking snow removing equipment. The questio=
n then
is how they want to police it. Tom Braun stated that since the ordinance is
already in place, it is a Town Board decision on how they want to police it=
. He
suggested that maybe it be posted with the snowplow policy.
Eric Minks explained that in section 700:280 it states t=
hat
a violation would be a “misdemeanor and shall be punished by a fine a=
nd
imprisonment not to exceed the maximum allowed by state”. He does not
think that they want anyone to go to jail over parking. He suggested making=
it
a petty misdemeanor.
John Moosbrugger suggested sending the parking issue bac=
k to
Town Board to see where they want to go with it since the ordinance is alre=
ady
in place.
The next item on the agenda was to appoint a Chairperson=
and
Vice Chairperson. Mark Riverblood motioned to table the item until after the
Township elections since some of the Planning Commission members were runni=
ng
for the Town Board and may not be on the Planning Commission. Eugene Stoeck=
el
seconded the motion. Motion Carried.
The next item up for discussion was the Public Hearing.
Eugene Stoeckel motioned to recommend approval to the Town Board to add a 60

The next item on the agenda was the Comprehensive Plan. =
After
some discussion Larry Ziebarth stated that he would put together an outline
using a sample from another township. He will also include some goals that =
they
would like to accomplish. He recommended that they put a notice in the annu=
al
newsletter stating that they are accepting ideas pertaining to the
Comprehensive Plan. John Moosbrugger suggested that they at least let the
residents know that the Planning Commission will be discussing the Comprehe=
nsive
Plan on the first Monday of every month and welcome them to come and
participate. Carl Sanford motioned to have Larry Ziebarth put together some
information for the next meeting. Eugene Stoeckel seconded the motion. Moti=
on
Carried.
The next item on the agenda was Open Forum. John Roxbury=
asked
the members if they all had access to emails because a lot of the informati=
on
was easily passed through the internet. He stated that it would save a lot =
of
time and postage if the Comprehensive Plan information was sent via e-mail.
Eric Minks stated the he also wanted to make a suggestion that all of the
agenda information be sent over e-mail if possible, with the exception of
information where a hard copy is required. All of the members agreed that w=
ould
be a good idea.
There were no other residents who wished to speak.
A motion was made by Mark Riverblood and seconded by Eug=
ene
Stoeckel to adjourn the meeting at 8:20 p.m. Motion Carried.
