Hearing
On Monday, December 7, 2009, at 7:15 p.m., Chairperson T=
om
Braun called a Public Hearing to order. The purpose of the Public Hearing w=
as to
consider a request from Larry Ziebarth for a Conditional Use Permit to oper=
ate
a home occupation for internet sales of merchandise, Section 35.
Other Planning Commission members present were Larry
Ziebarth, Carl Sanford, Kathy Stoeckel, Cindy Bodger and Town Board Liason =
John
Roxbury, Jr. Eric Minks was absent.
Larry Ziebarth explained that he will be selling items on
line. He designs websites, sells postcards and will be selling liquidated
merchandise. He explained that he has a tax number and would like to expand=
and
get a federal firearms license to sell guns over the internet. He also
explained that the selling of guns is an involved process regulated by the
Alcohol, Tobacco and Firearms regulations. They also regulate how those guns
are secured. He stated that he cannot sell to an individual that does not h=
ave
a firearms license and he will not be selling ammo.
Tom Braun motioned to close the Public Hearing at 7:22 p=
.m.
Regular
Meeting
At 7:30 p.m. Planning Commission Chairperson Tom Braun c=
alled
the Regular Monthly Planning Commission Meeting to order.
A motion was made by Larry Ziebarth and seconded by Cindy
Bodger to approve the minutes of October 5, 2009 as printed. Motion Carried.
The next item on the agenda was to discuss the Public He=
aring.
A motion was made by Carl Sanford to recommend approval =
to
the Town Board a CUP for Larry Ziebarth to operate a home occupation for
internet sales of merchandise with the condition that the CUP be not
transferable to any new owner or occupant of the property without condition=
al
use review and approval by the Board and Planning Commission. Cindy Bodger
seconded the motion. Motion Carried.
Carl Sanford stated that maybe the CUP should include a =
one
year review. John Roxbury stated that issue could be addressed when it came
before the Town Board.
The next item up for business was to review the ordinanc=
es
for fees that need to be moved into the township fee schedule. Larry Ziebar=
th
stated that he reviewed the ordinances, and in the Park ordinance, section
100:418, it states that there shall be a fee established by ordinance. He
stated there were no fees in any of the ordinances. There are two sections =
in
the first chapter of the ordinances that deal with penalties. One place it
states $100 and another place it states a penalty of $500, but that is not
fees.
Larry stated that in the future, if the ordinances are
changed, in one area it states that the amount should be established by
resolution from the Town Board and another area, it states that the Park
dedication fees shall be established by ordinance. Since those are two
different things they should probably be changed to both read by resolution
from the Town Board
The next item on the agenda was Open Forum. There were no
residents who wished to speak.
A motion was made by Larry Ziebarth and seconded by Carl
Sanford to adjourn the meeting at 7:37 p.m. Motion Carried.
