On Tuesday, October 20, 2009 at 7:30 p.m. Town Board C= hairperson Greg Anderson called the regular monthly Town Board meeting to order. Other Supervisors present were Mark Riverblood, Eugene Stoeckel, John Roxbury, Jr., and Dan Minks.

A motion was made by Mark Riverbloo= d and seconded by John Roxbury, Jr. to approve a Conditional Use Permit for Canda= ce Kutter, Section 35, to sell and store trailers with the following condition= s:
1. Hours of operation and deliveries: 8 a.m. – sunset, 7 days a week
2.<= span style=3D'font:7.0pt "Times New Roman"'> Maximum number of trailers on site, 30
3.<= span style=3D'font:7.0pt "Times New Roman"'> All trailers, equipment and inventory kept inside large storage building.
4.<= span style=3D'font:7.0pt "Times New Roman"'> No outside storage.
5.<= span style=3D'font:7.0pt "Times New Roman"'> No outside employees.
6.<= span style=3D'font:7.0pt "Times New Roman"'> Signage at mailbox to have address only. No advertising; maximum area of sign be 12” x 24”.
7.<= span style=3D'font:7.0pt "Times New Roman"'> No advertising of use permitted on the property.

The board discussed reviewing Interim Use Permits and = how that may be a consideration before their annual review is due.
A motion was made by John Roxbury, Jr. and seconded by= Dan Minks to approve a Conditional Use Permit for the City of Princeton, Section 29, to apply biosolids to Robert Soules farmland with the following conditi= ons:
1.<= span style=3D'font:7.0pt "Times New Roman"'> Applicant be granted a permit from the MPCA.
2.<= span style=3D'font:7.0pt "Times New Roman"'> Applicant must follow all rules, regulations and guidelines from MPCA.
3.<= span style=3D'font:7.0pt "Times New Roman"'> Any field tile lines shall be identified and staked on property.
4.<= span style=3D'font:7.0pt "Times New Roman"'> All wetlands shall be identified and staked on the property and be inspected by= the Township before any application.
5.<= span style=3D'font:7.0pt "Times New Roman"'> Areas on property where redox features are closer than 3’ to the surface, t= here shall be no application of biosolids.
6.<= span style=3D'font:7.0pt "Times New Roman"'> Biosolids must be incorporated into soil within 6 hours of application.
7.<= span style=3D'font:7.0pt "Times New Roman"'> Mille Lacs County Planning & Zoning be notified before any application.
8.<= span style=3D'font:7.0pt "Times New Roman"'> All County setbacks must be followed.
9.<= span style=3D'font:7.0pt "Times New Roman"'> A representative from the City of Princeton must be present during applicatio= n to supervise.

Todd McLouth explained th= at JL Jordan was requesting another partial payment for road work. He is about 95= % done and has a few things to complete yet. The amount of the partial payment consists of work that has already been done. The township would still be holding a retainage amount of $932.16 and are deducting $3200.00 for liquid= ated damages. Todd explained that work beyond the completion date is subject to $100.00 per day in damages. The original completion date was August 31= st but was extended to September 11th. The damages were calculated = from September 12th to October 13th. He also explained that the project will have a little bit of over run because there was additional gravel added to the roads. The cost of that is $4000.00.
Todd McLouth stated that = the seeding was done, however at this time, nothing will grow. He wanted to kno= w if the Town Board wanted to rely on the performance bond for next spring and i= f it doesn’t grow or get established they will have to ask Chad Jordan to = come back and fix it, unless they withhold a retainage until next spring and make the final payment then. He also explained that collecting on the bond is ve= ry difficult.
Todd stated that there ar= e about four items that need to be completed before final payment can be reviewed a= nd also told Mr. Jordan that until the time it is complete, damages are still being deducted. Chad Jordan stated that the work would be completed tomorro= w.
A motion was made by John Roxbury, Jr. and seconded by Eugene Stoeckel to approve a payment of $21,97= 9.02 to JL Jordan. Motion Carried.
A motion was made by Roxb= ury, Jr. and seconded by Eugene Stoeckel to approve a payment of $2,964.45 to Mille = Lacs County for the sign program. Motion Carried.
Open Forum=
Ken Henchen asked the Town Board what they wanted to do about the weather stripping on the garage doors, if they wanted it patched = up or just redone. A motion was made by John Roxbury, Jr. and seconded by Dan Minks to redo the weather stripping on the bottom of the garage doors. Moti= on Carried.
Ken Henchen asked if the Town Board wanted him to put = straw on the mound so it didn’t freeze. He thought that it froze last year because of a cracked pipe. John Roxbury said that since that is the only ti= me it has happened, he didn’t think the straw was necessary. Greg Anders= on did want Ken to block off the driveway so no one would be driving over where the pipe runs.

Eugene Stoeckel stated that the Princeton Fire Dept. h= as completed the new ISO ratings for the outlying areas.
John Roxbury, Jr. stated that there were some signs mi= ssing from the sign program but wasn’t sure that the ones missing were even needed. All of the signs that used to be up and now replaced with the new signs. The missing ones were just extra signs. If they wanted to pay for th= e missing ones they could order them through the County. John Roxbury, Jr. suggested = that during the road tour next year they could make a note of the signs they may want to order, but for now, just hold off on ordering the additional signs.=
John Roxbury, Jr. stated that they next door neighbor = is selling cars out front and is not sure if they are on township property. Br= ian Dahlheimer stated that the township does not own much on the other side of = the driveway.
John Roxbury, Jr. stated that 40th Street, = west of 75th, is in need of a culvert and class five gravel. Brian Dahlheimer stated that he has an extra culvert. Greg Anderson stated that B= rian can put in a culvert and the township will pay for his fuel and the gravel.=

Report
Todd McLouth explained that doing nothing regarding th= e 30 mph speed limit signs is OK until the sign needs to be replaced.
Mr. McLouth stated that he received an e-mail from Don Lubrecht regarding planting some trees. Todd told him to just make sure no trees get planted in the roadway.
Clerks Business
The Clerk stated that she had received a mile certific= ation from the County. Todd McLouth reviewed it and made a few corrections. The mileage went from 37.97 to 38.31.
The Clerk reminded the Town Board that there will be a meeting at the Township Hall on October 29 for the Parks and Trails discuss= ion.
The Clerk stated that she had received an e-mail from Baldwin Township stating that they will be maintaining their own roads this winter so Princeton Township does not have to plow the roads for them.
Greg Anderson stated that there was an issue that he w= anted the Town Board to be aware of. He explained that after Connie Heinks quit h= er job, she applied for unemployment. The unemployment office contacted the township and he corresponded with them since he is the one that took her resignation. He received about a 4 page document that he needed to fill out, which he did, verbatim, and copies are on file if any of the Supervisors wo= uld like to see it.
The paperwork was sent back to the Unemployment office= and the township had not hear back from them since. Then last week a bill was recei= ved for $2200 for unemployment benefits that had already been paid out to Connie Heinks. The Clerk called the unemployment office and was told that the case= was never judicated and appeared that the Township’s employer number was never matched up with Connie Heinks’ application for unemployment. The unemployment office was going to look into the issue and once they did, it = was decided that she should not have received benefits. She will now need to pay back the amount that was paid out to her. Greg explained that he does not k= now where the issue if going to go from here, if anywhere. She has the right to appeal and if she does it will then be her, a judge and himself reviewing t= he issue. He stated that everything was cut and dry on the information that he sent to the unemployment office. When she called him initially, she said th= at she quit and there was no ifs, ands or buts. She used some foul language and said that she was done. He told her not to quit and they would figure it ou= t, but she walked out with no notice. He explained that was the day before the budget and monthly meeting and it left the township in quite a fix to get everything changed over and to change all the information at the bank. It created quite a problem. He is not sure that she will appeal it but he want= ed everyone to be aware that she might. Dan Minks stated that he thinks she is going to. John Roxbury, Jr. stated that he does not think that the township should have to pay her anything since she quit. Greg Anderson stated that t= he unemployment office accidently paid her because of an oversight on their pa= rt. Mark Riverblood stated that it may be helpful to contact the unemployment office to see if they could note on the account that this was an error on t= heir part. Greg Anderson stated that he is just not sure what will happen from h= ere, if anything. The only complaint that she ever brought up to anyone was over= her demanding that Connie Wubben not attend her town board meetings. When he addressed the town board back in March, after her first demand that Connie Wubben not attend the meetings, he stated that he asked the board if they wanted Connie Wubben to stop coming to the meetings. John Roxbury, Jr. stat= ed that the board discussed the issue and agreed that they wanted Connie Wubbe= n to attend those meetings. Greg Anderson stated that when he talked to Connie Heinks the next day, she was very upset with that decision, but never heard another word about it, until the day that she quit, several months later. S= he called that day and was very upset and would not even talk about it, no not= ice or anything. He does not understand how they can be held liable for that. <= /p>
